Public Offer

This document is a public offer (a proposal to conclude a contract) from the individual entrepreneur "Alpenov R.Yu." (IIN 050810550438, Astana, Republic of Kazakhstan; the "Provider") addressed to any individual with legal capacity (the "User") who intends to use the til.lab service at tillab.app (the "Service").
Under Article 395(5) of the Civil Code of the Republic of Kazakhstan, this offer is public. Under Article 396(3) of the Civil Code, acceptance of the offer is constituted by registering on the site, ticking the consent checkbox, and/or paying for a subscription. Upon acceptance, the contract is deemed concluded on the terms of this offer.
The core features of the Service are provided free of charge and without payment, so the User may try the Service before purchasing a paid subscription.
1. Terms and definitions
- "Service", "til.lab" — the web application for learning the Kazakh language, available at tillab.app.
- "Provider" — the individual entrepreneur "Alpenov R.Yu."
- "User" — an individual who has accepted this offer.
- "Subscription" — paid access to the extended features of the Service for the term of the selected plan.
- "Plan" — a set of features and a price, published at tillab.app/pricing.
- "Auto-renewal" — automatic charging of the next subscription period to a saved bank card.
- "Account area" — the section of the Service for managing the account and subscription.
- "Payment service" — Freedom Pay (Paybox), which processes payments.
2. General provisions
The offer is published at tillab.app/offer and is available to the User before payment. The Provider recommends reading it in full before acceptance.
Use of the Service means the User agrees to this offer and to the Privacy Policy published at tillab.app/privacy.
3. Subject of the contract
The Provider grants the User access to the Service — a web application for learning the Kazakh language (interactive lessons, a suffix builder, texts, exercises, a phrasebook, and other features). Granting access is a service; no material result (goods) is created.
The Service is offered under the following plans: free (Free) and paid (Start, Pro), billed monthly or yearly. The features and current price of each plan are published at tillab.app/pricing and form an integral part of this offer.
4. Acceptance and conclusion of the contract
Acceptance of the offer is constituted by the User’s actions: registering an account, ticking the "I accept the Public Offer and the Privacy Policy" checkbox, and/or paying for a subscription (Article 396(3) of the Civil Code).
The contract is deemed concluded upon acceptance and remains in force until terminated as provided in this offer.
5. Price and payment
The subscription price is determined by the selected plan according to the prices published at tillab.app/pricing. All prices are stated in tenge (₸).
Payment is made by bank card (Visa, Mastercard) through the Payment service Freedom Pay (Paybox), including via Apple Pay, Google Pay, and Samsung Pay. The payment obligation is deemed fulfilled once the payment is confirmed by the Payment service.
Payment security is ensured via the 3-D Secure protocol. Card details are entered on the side of the PCI DSS-certified Payment service; the Provider does not receive or store card numbers.
The Provider applies a special tax regime; value-added tax is not included in the subscription price. Issuing-bank fees, if any, are paid by the User.
Access to the plan features is opened after payment is confirmed and lasts for the paid period.
6. Auto-renewal and recurring payments
When taking out a subscription, the User chooses one of the options: (a) a one-time payment for a single period without auto-renewal; or (b) a subscription with automatic renewal (recurring payments).
By choosing auto-renewal, the User gives explicit consent to periodic automatic charging of the next period’s price. The amount and frequency of charges are shown to the User before payment is confirmed.
Card details for recurring charges are stored on the side of the Payment service (PCI DSS); the Provider does not receive or store them.
The User may disable auto-renewal at any time in the Account area. After it is disabled, charges stop from the next billing period; access already opened remains until the end of the paid period.
7. Rights and obligations of the parties
The Provider undertakes to grant access to the features of the paid plan and to make reasonable efforts to keep the Service operational. The Provider may suspend access during technical maintenance and where the User breaches the terms of this offer.
The User undertakes to provide accurate data at registration, not to share account access with third parties, not to disrupt the Service or infringe the rights of third parties, and to use the Service in accordance with the laws of the Republic of Kazakhstan.
8. Refunds
The service is deemed duly rendered from the moment access to the paid plan features is granted. The price of a period already provided (rendered) is non-refundable.
This does not apply where the service is of inadequate quality or the Service is unavailable through the Provider’s fault: in that case the User may demand that the defects be remedied or a proportionate refund, in accordance with the laws of the Republic of Kazakhstan (including Articles 13 and 15 of the Law "On the Protection of Consumer Rights").
The User may at any time cease further use of the paid subscription by disabling auto-renewal in the Account area (Article 686 of the Civil Code); amounts for access already provided are not refunded.
Since core access to the Service is free, the User is able to evaluate the Service before paying.
9. Liability and force majeure
The Service is provided on an "as is" basis. The Provider makes reasonable efforts to keep the Service running without interruption but does not guarantee the absence of technical failures and outages.
The Provider is not liable for learning outcomes, which depend on the User’s effort, or for losses caused by circumstances beyond its reasonable control (force majeure): communication and equipment failures, third-party actions, changes in legislation, and similar events.
10. Personal data
The User’s personal data is processed in accordance with the Privacy Policy (tillab.app/privacy), which forms an integral part of this offer. By accepting the offer, the User consents to the processing and cross-border transfer of their personal data on the terms of that Policy.
11. Term and amendments to the offer
The offer is valid indefinitely until revoked by the Provider. The Provider may amend the terms of the offer and the plans by publishing a new version at tillab.app/offer.
Changes take effect upon publication unless the new version states otherwise. Continued use of the Service after a new version is published means the User agrees to the changes.
